FULL TERMS AND CONDITIONS
What You Need To Know:
We love running promotions for you guys and we want to be as clear as possible on how you enter and the prize is drawn. Please read the nuts and bolts below for the full details.
1. We know that there are BEAR snacks lovers all around the world, but this promotion is only open to residents of Great Britain (England, Scotland andWales), aged 18 and over.
In case you are under the age of 18, we ask you to contact your parents or legal guardians and ask them to participate in the Promotion on your behalf.
So that we are completely fair, anyone professionally connected to this promotion is not allowed to enter.
2. You will need to make a purchase to take part in this promotion. You’ll need to keep hold of the packaging of your purchase during the promotion period because we may ask for this so that we can validate your entry and confirm the winner. You will also need to have your own active email account and access to the internet in order to enter.
3. Promotion Period: You can enter between 00.01 BST on the 1st May 2023 and 23.59 BST on the 31st August 2023.
4. There will be a daily prize draw every day during the Promotion Period, and so a total of 123 daily prize draws by the end of the Promotion Period (the“Daily Prize Draw”). In addition to the Daily Prize Draw, five winners will be drawn at the end of the Promotion Period from all valid entries that have not won a Daily Prize Draw prize (the“Top 5 Winners Prize Draw”).
5. To Enter: Entering this promotion is simple, just purchase a participating promotional product (“Promotional Product”) and then visit www.bearsnacks.co.uk/goape and complete the online form with your details (name, postcode, email address and contact telephone number) to be entered into the relevant daily prize draw.

7. Sorry, but you may only enter once per household per day during the Promotion Period. If you do happen to enter multiple times, we’ll count your first entry, but any others will be ignored. Maximum 1 prize per person.
8. Prizes:
8.1 Daily Prize Draw: For each daily prize draw there will be one winner who will win 1x GoApe Treetop Adventure voucher for two people and two BEAR & Go Ape adventure kits. Overall, there will be a total of 123 winners, one for each daily prize draw that takes place every day during the PromotionPeriod.
8.2 Top 5 Winners Prize Draw: There will be five winners who will win a year-long subscription for Go Ape Treetop Adventure (limitedto 12 pairs of tickets) and a year’s supply of hampers from BEAR Snacks, withone BEAR bundle (valued at £50) sent each month.
9. Further Prize Details& Conditions:
a) Guests under the age of 18 must have written parental consent to participate unless they are accompanied by a parent or guardian.
b) Vouchers of the Daily Prize Draw are valid for a period of 24 months from the point of issue. Vouchers cannot be exchanged for cash. For more details on the vouchers, please visit https://goape.co.uk/gift-experiences/gift-voucher-terms.

e) Winners can visit https://goape.co.uk/locations to find their nearest Go Ape location.
f) Go Ape activities are subject to height restrictions and supervision ratios. Please check these before making your booking.
g) Once a winner has made a booking using their voucher or subscription card, the prize is only valid for the dates and times shown; any amendments to a booking will incur an admin fee. If you cancel the booking, no alternative tickets will be issued and for the avoidance of doubt, no compensation and/or refund will be provided either.
h) If you are a lucky winner, you’ll have to make sure that you and your guest behave in a proper manner. You are responsible for the way you behave and how your guest behaves whilst taking the prize. We, and Go Ape, reserve the right in our absolute discretion to exclude you and/or your guest from taking part in any aspect of the prize if you or your guest don’t comply with our directions or anyone we work with or the winner and/or guest act in a manner that is dangerous to themselves or to the public or is, in our opinion, anti-social in any manner or which causes a disturbance or nuisance to others. Failure to comply with these Terms and Conditions may result in refused entry, or the ticket holders being required to leave the venue.
i) You and your guest must abide by any relevant terms and conditions set by the venue which form part of your prize. It is your responsibility to ensure that you take care when moving around the venue. You and your guest will need to stick to therules, which, don’t forget, are part of your prize. And particularly, whilst at the venue, you must not: be drunk, intoxicated, under the influence of drugs, underage, be abusive, threatening, make or incite racial abuse, chant, use offensive language, make obscene gestures, throw items, behave anti-socially, bring animals (except guide dogs), carry offensive weapons or illegal substances, climb any structure you are not supposed to, make excessive noise, damage the venue or smoke outside of any designated areas. If you don’t stick to these Terms and Conditions then Go Ape may not let you in, or you may be asked to leave the venue.
j) We're sorry but you won't be entitled to any compensation and will have no claim against the Promoter if your booking with Go Ape is delayed, postponed, rescheduled or cancelled.
k) If for any reason your booking doesn’t go ahead as planned, e.g. because it’s been cancelled or for any other cause beyond our control which affects the running or conduct of this promotion, we may in our sole discretion cancel the prize and not re-award any additional tickets to the affected winners or reimburse any incurred expenses by a winner as a result of winning or accepting the prize.
l) For the avoidance of doubt, the prize doesn't include travel/transportation, accommodation, food, beverages, souvenirs, gratuities, car parking charges, excess baggage, additional excursions and attractions or any other costs of a personal nature (including spending money) that are not explicitly set out in these Terms and Conditions and neither the Promoter nor any provider of any part of the prize will be responsible for any such costs.
10. Winner Selection:
a. Daily Prize Draw: So that you know we’ve selected our winners fairly from all the validentries we receive, the random draw will be carried out by an independent promotional verification service (the “Fulfilment Partner”) to select 1winner for each Daily Prize Draw. The Daily Prize Draws will be conducted within 5 working days of the end of each relevant Promotional Week as per the table below:

b. Top 5 Winners Prize Draw: The Fulfilment Partner will also selectthe 5 winners for the Top 5 Winner Prize Draw at the end of the Promotion Period within 5 working days of the end of the Promotion Period.
11. Contacting the winner: We’ll contact the provisional winners via the email address that they provided with their entry within 5 working days of Winner Selection and will be asked to provide evidence ofidentity and eligibility. Reasonable efforts will be made to contact the winners. Once eligibility has been confirmed, the provisional winners will be confirmed as a winner. If a provisional winner does not respond to the initial contact within 14 days, we reserve the right to disqualify them. In the event that a winner doesn’t respond, the prize will be awarded to a reserve winner. We’ll select reserves in the same manner as above, and the time required for reserves to respond may be shorter. This will be detailed while notifying a reserve winner. In the event no winner responds, we reserve the right to not award the prize.
12. Prize Acceptance: If you are one of our lucky winners, we will send you your prize as soon as we can and they will be delivered to you within 28 days of the date you accept the prize when contacted by BEAR Snacks, in accordance with the details provided by you (Prize Acceptance). In the unlikely event that your prize doesn’t arrive within 28 days of your Prize Acceptance, you’ll have a further 28 days to inform us by emailing the team at: bear.uk@bearsnacks.com. If you don’t let us know within this time frame, we will reserve the right to not reissue the prize or limit its value at our sole discretion.
13. Sorry, but you can’t transfer the prize to someone else or exchange it for a cash alternative.
14. If, for reasons we can’t control, the prize is no longer available, we’ll offer you an alternative prize which we hope you’ll still love but which will definitely be of equal or greater value.
15. Provided no objection is received from the winners, the surname and county of residence of the winners will be made available by visiting www.promowinners.com/bearsnacks one month of the end of the Promotion Period for a period of 8 weeks. The winners can object to their surname or county of residence being published or request for the amount of information being published to be reduced by emailing the team at: bear.uk@bearsnacks.com. Without prejudice, we will provide this information to the Advertising StandardsAuthority on reasonable request.
The Legal and Other Bits
No one likes the small print, but we need to let you know about some other important stuff too and make you feel comfortable that we run our promotions properly, fairly (and legally!):
16. Data Privacy: We care a lot about the security of your personal data and it will be held in accordance with our Privacy Policy here: https://www.iubenda.com/privacy-policy/82514122/legal and will only be used for the purposes of this promotion and for research and analytical purposes, save where you have opted in to receive communications from BEAR Snacks. We will only share your data with our Fulfilment Partners to fulfil this promotion.
17. The Promoter may request that the winners participate in reasonable publicity arising from the Promotion. Participation is at the winner’s discretion and is not a condition of Prize Acceptance.
18. No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. We can’t guarantee continuous or secure access to www.bearsnacks.co.uk/goape.
19. We seek to run a fair and secure promotions andprevent abuse and cheating. If you enter in a way that is not consistent with these Terms & Conditions, your entries (and any of your associated aliases)will be disqualified, any Prize awarded may be void and recoverable, and we reserve the right to bar you from entering future promotions of ours for a period of at least six months. For this reason, we reserve the right at any point to:
a. Verify the eligibility of entrants and/or provisional winners through multiple means by requesting such information we consider reasonably necessary for this purpose. Entry or a Prize may be withheld unless and until verification is completed satisfactorily.
b. Disqualify entries that are not made directly by the individual entering the Promotion.
c. Disqualify entries made using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator.
d. Disqualify bulk entries from individuals, trade, consumer groups or third parties,incomplete entries and entries submitted by macros or other automated means.
e. Disqualify entries beyond the maximum allowed, or those using techniques such as ‘script’,‘brute force’, multiple SIM cards for Text entries, masking identity by manipulating IP addresses, using aliases or identities other than their own orany other means.
f. Disqualify entrants who tamper with the entry process.
g. Disqualify entries which, in some other way, do not fully meet the requirements of theseTerms & Conditions.
h. Cancel, modify or suspend the Promotion should it not be capable of running as plannedfor reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the controlof the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion.
20. Unfortunately, if you suffer any loss or damage that arises out of or in connection with the prize draw or the prize itself (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law, BEAR Snacks won’t be liable for this. Nothing will exclude our liability for death or personal injury as a result of our negligence.
21. We will not be liable for any failure to comply with our obligations or any delay in performing ourobligations within these terms and conditions If an act, omission, event or circumstance occurs caused by (but not limited to) global or regional health crises, weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, epidemic, pandemic, famine, plague or other natural calamities and acts of God or any other circumstances beyond our reasonable control.
22. If any provisions of these Terms & Conditions are judged to beinvalid, illegal or unenforceable, this will not affect or impact the continuationin full force and effect the remainder of the provisions.
23. We may refuse to award a prize in the event of any entrant’s fraud, dishonesty, breach or non-entitlement under these Terms & Conditions or seek recovery of its value if the prizes have been awarded.
24. In the event of a discrepancy between these Terms & Conditions and the details in any promotional material, the details in the Terms & Conditions will prevail.
25. By entering you confirm that you have read and agree to these Terms & Conditions.
26. These Terms & Conditions are governed by English Law and shall be subject to the exclusive jurisdiction of the English and Welsh Courts.
